DUI/DWI Information

The result of experience, specialization and technical support is success both in the courtroom and at the Department of Licensing suspension hearings. Remember that time is of the essence when an officer contacts you for DUI.

 

KNOW YOUR RIGHTS

If you are contacted by law enforcement it is important that you know your rights.  Washington State law provides individuals greater protections under our State Constitution than are provided under the US Constitution.   

TO THE CLIENT:  Upon being stopped by law enforcement:  
BE POLITE and:  
Hand the officer my card immediately before exiting your vehicle if possible.
Provide the officer with your license, insurance and registration.  
DO NOT consent to field sobriety tests.  
DO NOT answer questions.  
DO assert your right to an attorney/counsel.

SUBMIT TO A  BREATH/BLOOD TEST.

Blood Alcohol Content (BAC)

Showing estimated percent of alcohol in the blood by number of drinks in relation to body weight. This percent can be estimaed by:

  1. count your drinks (1 drink equals 1 ounce of 100 Proof liquor, one five ounce glass of table win or one 12-ounce bottle of regular beer).

  2. Use the chart below and under number of "drinks" and opposite "body weight" find the percent of blood alcohol listed.

  3. Subtract from this number the percent of alcohol "burned up" during the time elapsed since your first drink. This figure is .015% per hour. (Example: 180lb man - 8 drinks in 4 hours / 167% minus (0.15 x 4) = .107%)
